Terms of Service

1. The Service

Somniscient is an AI-powered dream journaling platform. It lets you record dreams via text or voice, and uses artificial intelligence to extract symbols and generate interpretations of your dream content. The service includes a free tier and paid subscription plans.

We reserve the right to modify, suspend, or discontinue any part of the service at any time. We'll give reasonable notice for significant changes when possible.

2. Accounts

You must be at least 13 years old to create an account. By signing up, you confirm that you meet this requirement.

You're responsible for keeping your account credentials secure. Don't share your password or let others access your account. Notify us immediately at support@somniscient.com if you suspect unauthorized access.

You may sign in using Google OAuth or email and password. You're responsible for any activity that occurs under your account.

3. Acceptable Use

You agree to use Somniscient only for lawful purposes and in accordance with these Terms. You must not:

• Use the service to store or transmit content that is illegal, harmful, threatening, abusive, or violates the rights of others
• Attempt to gain unauthorized access to any part of the service or its infrastructure
• Reverse engineer, decompile, or otherwise attempt to extract the source code of the service
• Use automated tools to scrape, crawl, or extract data from the service without our written permission
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Interfere with or disrupt the integrity or performance of the service

We may suspend or terminate accounts that violate these rules.

4. Subscriptions and Payments

Somniscient offers free and paid subscription plans. Paid plans are billed on a recurring basis (monthly or annually, depending on the plan you choose). Payments are processed by Lemon Squeezy, our payment provider.

By subscribing to a paid plan, you authorize us (via Lemon Squeezy) to charge your payment method on a recurring basis until you cancel. Prices are displayed at checkout and may change with notice.

You can cancel your subscription at any time through your account settings or by contacting support. Cancellation takes effect at the end of your current billing period. We don't offer refunds for partial billing periods, except where required by applicable law.

If a payment fails, we may downgrade your account to the free tier after a grace period.

5. AI-Generated Content Disclaimer

The dream interpretations, symbol analyses, and other AI-generated content provided by Somniscient are for entertainment and personal reflection purposes only. They are not medical advice, psychological advice, or a substitute for professional mental health care.

AI interpretations are generated by language models and may be inaccurate, incomplete, or not applicable to your situation. Do not make medical, psychological, or life decisions based on AI-generated dream analysis.

If you're experiencing distressing dreams, sleep disorders, or mental health concerns, please consult a qualified healthcare professional.

6. Intellectual Property

You own your dream content. The text, voice recordings, and notes you submit to Somniscient remain yours. By using the service, you grant us a limited license to store, process, and display your content solely to provide the service to you.

We don't claim ownership of your dream journal entries. We won't use your personal dream content for advertising or sell it to third parties.

The Somniscient platform itself — including its design, code, branding, and AI-generated features — is owned by us and protected by intellectual property law. You may not copy, reproduce, or distribute any part of the platform without our written permission.

7. Termination

You can delete your account at any time through your account settings. Upon deletion, your data will be removed in accordance with our Privacy Policy.

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if we're required to do so by law. We'll give notice where reasonably possible, except in cases of serious violations.

Upon termination, your right to use the service ends immediately. Sections of these Terms that by their nature should survive termination (including limitations of liability and intellectual property provisions) will continue to apply.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Somniscient and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) the service.

Our total liability to you for any claim arising from these Terms or your use of the service is limited to the amount you paid us in the 12 months preceding the claim, or $10 USD, whichever is greater.

The service is provided "as is" and "as available" without warranties of any kind, express or implied. We don't warrant that the service will be uninterrupted, error-free, or that AI-generated content will be accurate.

9. Indemnification

You agree to indemnify and hold harmless Somniscient and its operators from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the service, your violation of these Terms, or your violation of any third-party rights.

10. Governing Law

These Terms are governed by applicable law. Any disputes arising from these Terms or your use of Somniscient will be resolved through good-faith negotiation first. If that fails, disputes will be subject to the jurisdiction of the courts applicable to the operator's location.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we'll update the "Last updated" date at the top of this page. For material changes, we'll notify you by email or through the app. Continued use of Somniscient after changes take effect constitutes acceptance of the updated Terms.
